Know Your Rights
This is a painful and frightening moment for many in our communities. Fear and confusion thrive in times of uncertainty, but knowledge can bring clarity and help keep us safe.
No matter your immigration status, you have legal rights. If you encounter ICE in public or at home, knowing what to do can help you respond calmly and protect yourself and others.
KNOW YOUR RIGHTS: IF YOU ENCOUNTER ICE
Whether you are a U.S. citizen, a green card holder, a student on a visa, or undocumented, you have fundamental legal rights.
Immediate Steps: Stay Calm
Do not run or resist — this can escalate the situation.
Ask calmly: “Am I being detained, or am I free to leave?”
If you are free to leave, you may walk away calmly and silently.
If you are not free to leave, remain where you are.
Your Fundamental Rights
The Right to Remain Silent:
You do not have to answer questions about your birthplace, immigration status, or how you entered the country.
What to say: **“**I choose to remain silent.”
Right to Refuse Search:
You do not have to consent to a search of your person, your belongings, or your home.
What to say: “I do not consent to a search.”
The Door Rule:
If ICE agents come to your home, do not open the door.
Ask them to pass any warrant under the door or hold it up to a window.
Important: Identifying Warrants
Not all warrants are the same. Knowing the difference is vital:
Judicial Warrant:
Signed by a judge or court. This allows entry into a private space.
Administrative Warrant (Form I-200 or I-205):
Signed by an immigration official. This does not give them the legal authority to enter your home without your consent.
Critical "Don'ts"
Do not lie or provide false documents.
Do not sign anything without speaking to a lawyer first.
Do not physically interfere with the agents.
Next Steps if Detained
Ask for a lawyer immediately.
Document everything: Once you are in a safe position, write down badge numbers, the number of agents, and exactly what was said or done.
